This privacy policy (hereinafter - Policy) stipulates how we use the personal data that is collected from you, once you access or use mobile app: ClimatOn, and is intended to safeguard your privacy.

This Policy describes our approach to data privacy, explaining why and how we process your personal information ("Personal Data ") and your rights in relation to your Personal Data.

We are aware of our obligations with respect to Personal Data and its privacy and intend to process Personal Data securely and transparently. This Policy sets forth the types of Personal Data that we receive from you as the mobile app's user. We may amend or update this Policy from time to time. The “Last Updated” date at the top of this Policy reflects the effective date when such Policy has been changed last time. Please review our Policy on a regular basis. If you do not agree with the updated Policy, you should stop accessing and using the mobile app. Otherwise, it will mean that you agree with the last updated version of the Policy.

  1. Definitions used in the Policy

"Applicable data privacy laws" means Regulation (EU) 2016/679 (GDPR), or Model Law on Personal Data dated 29.11.2018 adopted by Interparliamentary Assembly of CIS Member nations, or any national or internationally binding data privacy laws or regulations that may be applicable at any time during the term of this Policy;

"Data Controller" means the natural or legal entity which determines the purposes and means of the processing of Personal Data;

"Data Processor" means the legal entity processing Personal Data on behalf of the Data Controller;

"Personal Data" means any information relating to the identified or identifiable natural person;

3.1. Personal Data, which we collect and process, include:

  • Surname and name – for natural persons;
  • Company name and tax identification number – for legal entities;
  • Telephone number;
  • E-mail;
  • Shipping address;
  • Data that is automatically transmitted to the services of the mobile app in the course of their use via the software installed on the User's device, including the phone ID, IP address, tokens, SSIDs.

3.2. We and our employees receive all Personal Data directly from you with your consent.

3.3. Personal Data which you provide to us:

  • Is processed lawfully, fairly and in a transparent manner in relation to you;
  • Is collected by us only for purposes specified herein and not further processed in a manner that is incompatible with these purposes;
  • Is adequate, relevant and limited to what is necessary in relation to these purposes;
  • Is kept in a form which permits identification of data subjects only in the scope which is necessary for the purposes for which the Personal Data is processed;

In general, we only keep your Personal Data for the time necessary to fulfill the purpose of collection or further Processing, namely control of the products, demonstration of the products placed on the mobile app and relevant information about them, performance of sale and purchase agreements for the products and relevant services. In order to determine data retention periods we take into account:

  • whether Personal Data is processed based on your consent;

We would like to make sure you are fully aware of your Personal Data protection rights. Each User is entitled to the following:

  1. Use and transmission of Personal Data

6.1. Personal Data is processed for the purposes of control of the products, demonstration of the products placed on the website and relevant information about them, performance of sale and purchase agreements for the products and relevant services on the mobile app. We collect Personal Data only to the extent necessary to achieve the named purpose.

6.2. We may share Personal Data with such services like Google Analytics and weather services to recognize and understand user preferences, make improvements, and for other business purposes. The collection and use of information by these companies is governed by the relevant third party’s privacy policy and is not covered by our privacy policy.

6.3. Your Personal Data will be shared with colleagues within our Company or our Company contractors where it is necessary for them to undertake their duties to fulfill your requests.

We may share your Personal Data with bodies located in the countries where the Company operates (including outside the European Union).  Processing may include, among other things set forth in this Policy, the fulfillment of your order, the processing of your payment details and the provision of services. By submitting your Personal Data, you agree to this transfer, storage or processing.  We have put the following measures in order to ensure that your Personal Data is transferred and held securely and that the bodies, who receive Personal Data, process it in the way required by Applicable data privacy laws:
